Terms of Service

The agreement

These terms apply when you use Publixy AI ([https://YOUR-DOMAIN]), operated by [COMPANY LEGAL NAME]. By signing in you accept them. If you use Publixy AI for a business, you accept them for that business.

Your account

  • You must be at least 18 and sign in with a Google account you control.
  • You are responsible for what happens under your account. Tell us at once if you think someone else has used it.
  • Each account has usage limits on AI generation and Instagram analysis. We may change them.

Your content

You keep the rights to what you put into the service and, as far as the law allows, to what it generates for you. You give us the permission we need to store, process and display that content in order to run the service, including showing a published book's store page and cover to the public and delivering the book to its buyers.

AI-generated content

Books, store pages, emails and analyses are generated by AI models. They can be wrong, incomplete or similar to existing material. Review everything before you publish, sell or send it: you are responsible for what you publish under your name.

Acceptable use

You must not use the service to:

  • publish anything unlawful, misleading, defamatory or infringing;
  • send email to people you have no lawful basis to contact, or ignore an unsubscribe;
  • impersonate anyone, or present AI-generated claims about a real person as fact;
  • harass anyone, or use Instagram analysis for anything other than lawful business research;
  • get around usage limits, probe or overload the service, or reverse engineer it.

Email campaigns

You are the sender of every campaign you publish and you are responsible for following the email marketing laws that apply to you and your contacts (for example CAN-SPAM, the GDPR and ePrivacy rules, and CASL). You confirm you may email each list before publishing it. We add an unsubscribe link and your business address to every email, honour unsubscribes and bounces, and may pause sending that produces high bounce or complaint rates.

Selling your books

  • You are the seller of the books you publish. PayPal processes each payment and pays you, and any partner on your revenue agreement, directly.
  • Publixy AI charges a platform fee of 2% of each sale, taken at payment. PayPal's own fees are separate and set by PayPal.
  • You are responsible for the taxes on your sales (such as VAT or sales tax), for your refund policy and for the consumer law that applies to selling digital content.
  • Each buyer keeps access to the edition they bought. Publishing a new edition does not change what earlier buyers received.

Buying a book

A purchase gives you personal access to that edition of the book in your library, including a PDF download. The seller is responsible for the book and for refunds. [CONFIRM THE WITHDRAWAL-RIGHT WORDING FOR DIGITAL CONTENT SOLD TO EU CONSUMERS.]

Changes, suspension and ending

We may change or discontinue features. We may suspend or close an account that breaks these terms or puts the service or other people at risk. You can stop using the service at any time and ask us to delete your account.

Disclaimers and liability

The service is provided as it is and as available. To the extent the law allows, we are not liable for indirect or consequential losses or lost profits, and our total liability for any claim is limited to the fees we received from you in the twelve months before it.
